ARTICLE 1: SCOPE

These general terms and conditions of sale apply to all sales made via the website https://eleanor-charlotte.com/.

ARTICLE 2: ORDERS

Automatic registration systems are considered proof of the nature and content of the order. Eleanor & Charlotte® confirms receipt of the order to the customer at the email address provided.
The sale is deemed complete on the date Eleanor & Charlotte® validates payment for the order — that is, the date payment is approved for online card payments, or the date payment by cheque is received.

Eleanor & Charlotte® reserves the right, in all circumstances, to refuse or cancel an order from a customer with whom there is a dispute relating to the payment of a previous order.

ARTICLE 3: PRODUCT AVAILABILITY

Our offers and prices are valid as long as they are visible on the website. Availability at the time of the customer’s visit depends on stock levels at Eleanor & Charlotte® and, of course, at our suppliers.

To build our catalogue and product range, we work with databases enriched with information provided by our suppliers. As this database contains several hundred products, not all items are held in our own stock, and our offers therefore depend on supplier availability.

Only if a product is permanently out of stock with the supplier will it be removed from sale. Otherwise, a new order can generally be placed within a certain period.

If a product ordered is unavailable, the customer will be informed by email or on the invoice if the order contains multiple products.

Order delivery time:
At the time of ordering and in the order confirmation, the customer is informed of an estimated delivery time. This is calculated by adding the availability time of the longest-available item to the transport time of the selected delivery method.
The customer may cancel the order as long as it has not yet been dispatched.

Special cases:

Pre-orders:
Products not yet released may be offered on https://eleanor-charlotte.com/ as pre-orders. These are reserved with a release date provided by the publisher at the time of reservation. This date may change without notice and is solely the responsibility of the publisher.
Eleanor & Charlotte® will always endeavour to ship products to customers as quickly as possible from the final release date, subject to stock availability.

ARTICLE 4: PRICES

Prices shown in euros are net prices, excluding delivery costs. The price includes the product cost as well as handling, packaging, and storage costs. Prices may change without notice, but products are invoiced according to the terms in force at the time the order is confirmed.

All orders are invoiced in euros and must be paid in euros. Any customs duties or local taxes are payable by the recipient.

ARTICLE 5: DELIVERY COSTS

Delivery costs include a contribution towards preparation, packaging, and postage. We recommend grouping all items into a single order. We cannot combine two separate orders, and delivery charges will therefore apply to each order.

ARTICLE 6: PAYMENT

You have several secure payment options available:

  • By credit or debit card (Visa, Eurocard/Mastercard) directly on the website via a secure SSL-encrypted payment page, where you will be asked to enter the card type, card number (without spaces), security code (on the back of the card), and expiry date.

  • Via PayPal.

Payments are processed through our partners’ secure banking servers. This means that no banking information is transmitted via the website https://eleanor-charlotte.com/.

Card payments are therefore completely secure. Your order is recorded and validated as soon as the bank approves the payment.

ARTICLE 7: DELIVERY

We deliver to your home address or to a collection point. Delivery time includes both preparation and transport time. Eleanor & Charlotte® delivers worldwide.
The buyer is informed by email of the different stages of order processing: preparation and dispatch.

The stated delivery time of 10 to 20 days is calculated from the date the customer receives confirmation that the order has been dispatched. This delivery time is provided by the carrier and does not constitute a legal obligation on the part of Eleanor & Charlotte®.

ARTICLE 8: WARRANTY – RETURNS – REFUNDS – RIGHT OF WITHDRAWAL

Products sold on https://eleanor-charlotte.com/ are new and guaranteed free from defects. They correspond to those found in traditional retail outlets and are supplied by the indicated publishers and suppliers.

In the event of a defect or non-conformity, the customer has 15 working days from receipt to request an exchange or refund. If the 15th day falls on a Saturday, Sunday, or public holiday, the deadline is extended to the next working day.

The customer must return the product unused, complete, and in its original packaging, together with any accessories, manuals, and documentation (in original packaging and with the invoice).
The customer must send proof of the defect to contact@eleanor-charlotte.com (including a description and photos).

When exercising the right of withdrawal, Eleanor & Charlotte® will refund the full amount, excluding return shipping costs. The refund will be issued no later than 14 working days after receipt of the returned item.

Return shipping costs are borne by the customer.

In the event of a refund, we guarantee that the amount will be reimbursed within 14 days of receiving the returned product. Cash on delivery (COD) shipments are not accepted under any circumstances.

ARTICLE 9: RETENTION OF TITLE – TRANSFER OF RISK

Ownership of the products transfers to the buyer only once full payment has been received, regardless of the delivery date.
However, the risk of loss or damage to the products transfers to the buyer upon delivery and receipt of the goods.

ARTICLE 10: PERSONAL DATA PROTECTION

Eleanor & Charlotte® is the producer and owner of all or part of the databases on this website. By accessing the website, the customer acknowledges that the information contained herein is legally protected.
The customer therefore undertakes not to extract, reuse, store, reproduce, display, or retain — directly or indirectly, on any medium, in any form — all or a qualitatively or quantitatively substantial part of the content of the databases on the website.

ARTICLE 11: LIABILITY

Product descriptions in the database on https://eleanor-charlotte.com/ are based on information provided by publishers. Eleanor & Charlotte® cannot be held responsible for the content of these works and cannot be held liable to the buyer.

Eleanor & Charlotte® cannot be held liable in the event of force majeure (strike, flood, fire, etc.).

The products offered comply with current UK legislation. Eleanor & Charlotte® declines all responsibility if the delivered product does not comply with the legislation of the recipient’s country (for example, censorship or bans on certain titles or authors).

Eleanor & Charlotte® is not responsible for the content of external websites accessible via hyperlinks from its site.

ARTICLE 12: APPLICABLE LAW

All provisions of these general terms and conditions of sale, as well as all purchase agreements to which they apply, are governed by the laws of the United Kingdom.

ARTICLE 13: CUSTOMER ACCEPTANCE

These general terms and conditions of sale and price lists are expressly accepted by the buyer, who acknowledges having full knowledge of them.
The buyer therefore waives the right to rely on their own purchasing conditions or any other conflicting documents, as the completion of the purchase constitutes acceptance of these terms.

These terms may be amended without notice by Eleanor & Charlotte®.
The general terms and conditions of sale were last updated on 1 January 2024.
